Following are the terms of the Privacy Policy of RentbyBoater.com (the "Website") and its owners and/or operators (collectively, "RBB").

1. Information Collected. RBB collects and stores information from potential or actual renters, boat owners, or advertisers on the Website (collectively, "Users"). Such information includes names, addresses, telephone and facsimile numbers, e-mail addresses, payment information, search preferences, vessel identification information (e.g., make, model, registration number), renter reviews and other information which may personally identify the User. This information is generally collected directly from the User in the registration process, and may be updated from time to time by sending an e-mail to customerservice@rentbyboater.com or logging on to the Website and clicking the Personal Profile Section under Account Details. RBB stores and uses such information in the operation of the Website and may pass such information along to its affiliates or third parties under contract with RBB for the processing and tracking of such information and/or advertising on behalf of RBB (RBB and such affiliates and third persons are collectively referred to herein as the "RBB Group"). By providing information to the Website, each User agrees and consents to such use by the RBB Group.
2. Use of Information. The RBB Group will use this information to promote the Website and its services, to process any payments due to the RBB Group from a User, to provide the services identified on the Website, and to provide User support. The RBB Group may send information to a User at the mailing address and/or e-mail address provided by the User, including without limitation information for the purpose of advertising goods and services provided on the Website, Website updates or operational information about the Website and the User's account. The RBB Group may also, from time to time, send newsletters designed for one or more subsets of Users and surveys regarding the use of the Website by a User and their experience in dealing with other Users.
3. Rental Inquiries. If a User sends an inquiry through the Website regarding a listed good or service (for example, a vessel rental), that User's identifying information, including the User's name, e-mail address and phone number, as well as information about the renting party (for example, the requested date(s), and number in the party) and, if so desired, ratings of past experiences with the receiving User, will be transmitted to the User receiving the inquiry. It is the inquiring User's responsibility to complete the inquiry form and provide only that information he or she wishes to disclose; if information a User does not wish to disclose is required to complete the form, then it is the User's responsibility to make the determination of whether to not submit the inquiry or to disclose the information and submit the inquiry. The receiving User will receive the information in the inquiry and in subsequent lists he or she receives listing his or her renters. In addition, the RBB Group may access and retain the inquiries, and use them for the purposes of providing support to Users (e.g., identifying all inquiries a particular User has received) and tracking and analyzing inquiry patterns.
4. Protection of Information. The RBB Group takes reasonable precautions to protect the personal information of its Users from unauthorized or unlawful access or use. Such precautions include technical and organizational security measures on access to the RBB Group's databases. However, the RBB Group disclaims all liability for any improper, unauthorized, or unlawful use or access of a User's personal information. It is the User's responsibility to protect against improper, unauthorized, or unlawful use of the User's information, which includes limiting access to the User's account on the Website, username and password.
5. Sharing of Information. RBB may share your information with other parties within the RBB Group. Such other parties assist in the operation of the Website and offer or provide Users of the Website with additional goods and services, and are subject to confidentiality provisions by either agreement or applicable law. Other members of the RBB Group or third parties under agreement with RBB (e.g., advertisers) may collect information about Users using cookies, web beacons or other devices, but such information is collected on an anonymous basis and personal identifying information about Users is not collected or retained in such circumstances. RBB does not sell personal identifying information about its Users to third parties. Notwithstanding anything herein to the contrary, the RBB Group may disclose any User information if required to do so by law or pursuant to a request or inquiry by law enforcement or other governmental agency.
6. Opt-Out. A User may opt-out of receiving marketing materials from the RBB Group by e-mailing RBB at customerservice@rentbyboater.com and requesting to be taken off the list, and RBB shall have thirty (30) days to remove a User from the list after receiving the User's request.
7. Retention of User Information. Personal identifying information of Users may be retained by the RBB Group so long as necessary for the purposes of operating the Website and any other purposes consented to by the User, and as long as required by applicable law. The RBB Group will delete User information after the expiration of such period in accordance with its regular deletion schedule.
8. Amendments. The Website's owners and/or operators reserve the right to amend, rescind or otherwise modify any portion or all of this Privacy Policy at any time. Any such amendments, rescissions, or other modifications and their effective date shall be posted on the Website.
9. Severability. In case any one or more of the provisions contained in this Agreement shall, for any reason, be held to be invalid, illegal or unenforceable in any respect, such invalidity, illegality or unenforceability shall not affect any other provisions of this Agreement, and this Agreement shall be construed as if such invalid, illegal or unenforceable provision had never been contained in this Agreement.
10. Headings. The headings of the various sections herein contained are intended for ease of reference only and are not to be construed as evidence of the intent as to the contents thereof.
11. Terms and Conditions. This Privacy Policy is further subject to the Terms and Conditions of the Website and it is RBB's intent that both documents be read as a whole and consistent with one another.
